Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Ola AI website, dashboard, APIs, and AI voice agent service (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization.

1. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

2. The Service

Ola AI provides an AI voice agent that handles inbound and outbound calls, qualifies leads, books showings, and integrates with third-party CRMs and telephony providers. We may modify, add, or remove features at any time.

3. Acceptable use

You agree not to:

  • Use the Service for unlawful, deceptive, harassing, or harmful purposes.
  • Place outbound calls in violation of TCPA, CAN-SPAM, do-not-call rules, or any other applicable law.
  • Misrepresent the AI agent as a human when disclosure is legally required.
  • Reverse engineer, scrape, or attempt to extract underlying models.
  • Resell or sublicense the Service without our written consent.

4. Customer data and content

You retain all rights in the data, listings, scripts, and recordings you provide or that the Service generates on your behalf ("Customer Data"). You grant Ola AI a worldwide, non-exclusive license to host, process, and transmit Customer Data solely to provide and improve the Service. You are responsible for the accuracy and legality of Customer Data and for obtaining any required consents from callers.

5. Fees and billing

Paid plans are billed in advance on a recurring basis. Fees are non-refundable except as required by law. We may change pricing with at least 30 days' notice before your next renewal.

6. Third-party services

The Service integrates with third-party providers (CRMs, telephony, AI models). Your use of those services is governed by their own terms, and we are not responsible for their performance.

7. Confidentiality

Each party agrees to protect the other's non-public information disclosed in connection with the Service using at least the same care it uses for its own confidential information, and to use it only to perform under these Terms.

8. Intellectual property

Ola AI and its licensors own all rights in the Service, including software, models, documentation, and trademarks. We grant you a limited, revocable, non-exclusive license to use the Service during your subscription, subject to these Terms.

9. Termination

You may cancel your subscription at any time from the dashboard. We may suspend or terminate your account for material breach, non-payment, or to protect the Service or other users. Provisions that by their nature should survive termination will do so.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI-GENERATED RESPONSES MAY BE INACCURATE; YOU ARE RESPONSIBLE FOR REVIEWING THEM BEFORE RELYING ON THEM IN A REGULATED CONTEXT.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OLA AI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You will defend and indemnify Ola AI against third-party claims arising from your Customer Data, your use of the Service in violation of these Terms, or your violation of applicable law.

13. Governing law

These Terms are governed by the laws of the State of Delaware, USA, excluding its conflict-of-laws rules. The exclusive venue for disputes is the state and federal courts located in Delaware.

14. Changes

We may update these Terms from time to time. Material changes will be announced in the dashboard or by email. Continued use after the effective date constitutes acceptance.
